COMPANION DOG CONTRACT

·        We, Anna and Matt Layman (hereinafter designated as SELLER), guarantee this_____________puppy to be healthy and free of disease upon receipt by  BUYER.  SELLER to produce a healthy puppy. SELLER will stand behind this sale to the extent stated below. However, BUYER accepts full responsibility for the proper care once the puppy/dog leaves the SELLER. SELLER cannot be held responsible for the death, injury, deformity, or temperament of the pup due to illness, accident, or deviation from adequate care herein stated and socialization required for your chosen puppy.

·        I, ________________________ (hereinafter designated as BUYER), agree to have this puppy examined by a licensed veterinarian within three (3) days of receipt. If health problems are found, the animal may be returned to SELLER within seven (7) days for a replacement puppy if one is available or when one becomes available or a reimbursement.  The maximum amount for reimbursement upon return of the dog will not exceed the original purchase price.  No reimbursement of vet bills or future vet bills will be reimbursed by seller unless dog is returned.  If dog/puppy dies under a vets care the buyer will be reimbursed, but not to exceed 150% of the original purchase price.  If vet bills exceed 100% of the original purchase price and seller was not notified before care was given, buyer will not be compensated.

·        This dog is being sold as a "Family pet".  It is not required that the BUYER have this dog spayed/ neutered.

·        All puppies are sold as (PET QUALITY) with Full Registration unless otherwise noted.

·        A (non-refundable) deposit will be required to hold chosen puppy. If you decide you do not want the puppy you will lose your deposit, and we will find a new owner for the puppy. The remainder amount owed on the puppy will be paid at Pick Up.

·       SELLER guarantees that this dog has no obvious defects. However cocci, kennel cough, and common colds are not reason for return.  It is recommended that this dog have a fecal test if disease is found total investment but no more than will be bought back at total purchase price within 5 days.

·        GUARANTEE: This puppy/dog is guaranteed to be free of any inherited defect resulting in a significantly shortened life span (i.e. the dog dies or has to be euthanised prior to1 year of age because of this diagnosed defect AND the accepted current veterinary medical therapies have failed to afford the dog an acceptable quality of life.) Determination of what constitutes a hereditary defect is to be a unanimous agreement of two (2) veterinarians agreeable to both parties. Costs of the opinions are to be assumed by the buyer. If such a problem should develop, the breeder shall replace the puppy/dog free of charge to the owner if the original dog is spayed or neutered or if the defect of the dog is severe enough to warrant the animal to be destroyed (as deemed by a qualified veterinarian.) The decision is between the breeder and owner and fulfilled within one year of the problem developing. This guarantee does not apply to any damage, neglect or injury caused by negligence, improper nutrition/health care, and accident or if the dog has been bred.

·        If BUYER is unable to keep this pup/dog for any reason, BUYER agrees to return it to SELLER and foregoes all rights to said puppy/dog. This puppy/dog may not be sold, given away, placed in an Animal Shelter, or euthanasia. The exception to euthanasia would be in the case of severe injury or suffering on the part of the dog.

·        BUYER agrees to provide an adequate home to ensure this dog's safety; and to provide adequate protection from excessive heat and cold. This dog shall be neither chained, continuously tied nor allowed to roam at large.

·        BUYER agrees to provide adequate veterinary care and to provide necessary medical treatment in the event of an accident/injury to the dog.  It is highly recommended that BUYER take this dog to puppy kindergarten and/or obedience classes.

·        BUYER agrees to pay ___hundred and NO/100 dollars ___for this

      ______________to be picked up by BUYER.  Payment must be received in full by cash or cashier’s check or authorized personal check.  If shipped we require cost of pup/dog, health certificate and air fare before we process the shipping.

·       The BUYER understands that this puppy is sold with full _AKC_ registration. 

·        SELLER recommends a “Titer” test be done at 1, 3 and 6 years of age to see if said dog needs to be re-vaccinated. SELLER will not be responsible for any immune problems such as mange, skin allergies, seizures or intestinal disorders that may occur after vaccinating this puppy.

·        Violations of the terms of this contract renders all guarantees stipulated in this contract to be null and void and may result in the buyer being required to return the Puppy/Dog to the SELLER within five days of receipt of written notice from the BREEDER.  No refund will be given to the BUYER in this event.

·        The BUYER will sign the registration papers transferring ownership back to the Breeder, and surrender the Dog, the registration papers and the contract back to the SELLER.

·         If the BUYER fails to return the Puppy/Dog when requested in writing for failure of contractual obligations, the SELLER reserves the right to immediately repossess the Puppy/Dog, the Dog's registration papers (signed by the BUYER transferring ownership back to the SELLER) and this contract.

·        The SELLER reserves the right to pursue any and all other remedies as provided by law, including pursuit in a court of law, of return of the Puppy/Dog to the SELLER, compensatory damages, attorney fees and court costs.
